North Carolina — Contractor Lien Waiver Resources
North Carolina prescribes no waiver form, but § 44A-12(f) draws a bright line at the start of a job: the right to file a claim of lien cannot be traded away to win the contract. The rest of § 44A-12 then runs on a clock — 120 days — that belongs on every North Carolina contractor’s wall.
What the official source states
Official source: G.S. § 44A-12(b) and (f) — https://www.ncleg.gov/EnactedLegislation/Statutes/HTML/BySection/Chapter_44A/GS_44A-12.html
- An agreement to waive the right to file a claim of lien on real property — or the right to serve a notice of claim of lien upon funds — made in anticipation of and in consideration for the awarding of any contract for an improvement is against public policy and unenforceable (G.S. § 44A-12(f)).
- Subsection (f) does not prohibit subordination or release of a lien — what it bans is the advance waiver extracted as the price of getting the work.
- Claims of lien on real property must be filed in the office of the clerk of superior court in each county where the property is located, not later than 120 days after the last furnishing of labor or materials by the person claiming the lien (§ 44A-12(a)–(b)).
Source note: The linked page is the codified text of G.S. § 44A-12 on the General Assembly’s official site (ncleg.gov), confirmed in a live-browser check on 2026-10-27: subsection (f) and the 120-day filing rule in subsection (b) confirmed. Subsection (f) was originally added by Session Law 1983-888.

What this means for your paperwork
- Put the 120-day last-furnishing deadline in your milestone tracker the day work starts, per county and per job.
- If a contract conditions the award on waiving lien rights, that clause is what (f) addresses — raise it before signing, with an attorney.
- Keep first- and last-furnishing dates documented (delivery tickets, daily logs); the filing clock runs from them.
