Arizona — Contractor Lien Waiver Resources
Arizona is a form state with teeth: under A.R.S. § 33-1008 a lien waiver that does not substantially follow one of the four forms printed in the statute is unenforceable. If you work in Arizona, the waiver paperwork is not a place for a house template.
What the official source states
Official source: A.R.S. § 33-1008 — https://www.azleg.gov/viewdocument/?docName=https://www.azleg.gov/ars/33/01008.htm
- The statute prints four forms: Conditional Waiver and Release on Progress Payment, Unconditional Waiver and Release on Progress Payment, Conditional Waiver and Release on Final Payment, and Unconditional Waiver and Release on Final Payment (§ 33-1008(D)).
- A waiver or release is effective only if it follows substantially one of those forms and is signed by the claimant or the claimant’s authorized agent; for a conditional release there must also be evidence of payment (§ 33-1008(A)).
- No statement that waives, releases or hurts a lien claim is enforceable unless it is on a properly executed statutory waiver or the claimant has actually been paid in full for the claim (§ 33-1008(B)).
- The unconditional forms carry a statutory Notice — printed in type at least as large as the largest type otherwise on the document — warning that the document waives rights unconditionally and states that you have already been paid.
Source note: Arizona’s legislature notes that the ARS text on azleg.gov is maintained for legislative drafting and that the official version of the Arizona Revised Statutes is published by Thomson Reuters. Read the linked section and confirm it for your situation.

What this means for your paperwork
- Match the form to the moment: conditional before the money lands, unconditional only after it has.
- Keep evidence of payment with every conditional release — the statute makes it part of the release’s effectiveness.
- Log the through-date and the payment the waiver covers in your waiver tracker; Arizona disputes usually start with a mismatch there.
