Illinois — Contractor Lien Waiver Resources
Illinois prescribes no lien waiver form at all — and that is not the gap it looks like. The document Illinois law does prescribe, in detail, is the contractor’s sworn statement, and the waiver rule is a single sentence every Illinois contractor should know before signing a contract.
What the official source states
Official source: 770 ILCS 60/1 and 60/5 — https://ilga.gov/Legislation/ILCS/Articles?ActID=2254&ChapterID=63&Chapter=LIENS&MajorTopic=RIGHTS%20AND%20REMEDIES&Print=True
- An agreement to waive (or subordinate) any right to enforce or claim a lien under the Mechanics Lien Act, made in anticipation of and in consideration for the awarding of a contract or subcontract, is against public policy and unenforceable (770 ILCS 60/1(d)).
- Taking additional security is not a waiver of lien rights unless the parties make it one by express agreement (60/1(c)).
- Before an owner pays the contractor, the contractor must give a written statement under oath listing the parties furnishing labor, services, material, fixtures, apparatus, machinery or forms/form work, and the amounts due or to become due to each (60/5(a)).
- For an owner-occupied single-family residence, the contractor must also give the owner a printed statutory notice, in at least 10-point boldface, that the law requires that sworn statement before any payments are made (60/5(b)).

What this means for your paperwork
- Build your draw routine around the sworn statement: update names and amounts due before every payment, not after.
- Keep signed copies of each sworn statement with the pay application it supported.
- If a contract asks you to waive lien rights up front, 60/1(d) is the section your attorney will cite — flag it before signing.
